*Multimedia Usage of Children’s Stories for Reunion

In the reunion resource materials several children’s stories are suggested. Inquiries have been made regarding the possibility to scan and then project these resources. When the community gathers the suggestion to project the materials would provide more inclusion. While no blanket permission exists from the publishers of the resources, consultation with the legal department provides the following guidance.

The Community of Christ tries at all times to comply with copyright regulations. However, the fair use exception to copyright law permits the projection of excerpts of copyrighted materials under some conditions. This would have to be limited to no more than 10 - 15 percent of the contents of the book. An example of potential application of the provision would be if a book is 50 pages in length five to seven and one-half pages would be allowed to be projected to exercise the provisions of fair use.

The specifics of the Fair Use provisions are below:

Notwithstanding the provisions of sections 17 U.S.C. § 106 and 17 U.S.C. § 106A, the fair use of a copyrighted work . . . for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include:

  1. the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
  2. the nature of the copyrighted work;
  3. the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
  4. the effect of the use upon the potential market for or value of the copyrighted work.

In the future attempts will be made to provide for blanket permissions form publishers. In the event this is not possible, fair use provisions should be followed.
